By accessing or using HarborSignal (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. HarborSignal reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
HarborSignal is a maritime data analytics platform that aggregates publicly available vessel traffic data, displays port congestion metrics, and generates AI-produced pattern analysis for informational purposes. The Service includes a web dashboard, data visualizations, and automated analysis outputs.
HarborSignal operates as a bona fide publisher of financial and market information. All content produced by the Service is general and impersonal in nature — it is distributed simultaneously and identically to all users and is not tailored to the investment needs, objectives, risk tolerance, financial situation, or personal circumstances of any individual user. HarborSignal does not know your individual circumstances and does not provide personalized advice of any kind.

HarborSignal is an information and data platform only. Nothing on this platform — including AI-generated signals, trade ideas, port analysis, price data, or any other content — constitutes financial advice, investment advice, trading advice, or a recommendation to buy, sell, or hold any security, futures contract, ETF, currency, or any other financial instrument.
HarborSignal is not registered as an investment adviser under the Investment Advisers Act of 1940, is not a broker-dealer registered with the SEC or FINRA, and is not a financial planner. HarborSignal relies on the publisher's exemption under Section 202(a)(11)(D) of the Investment Advisers Act of 1940 for content relating to securities.

4. AI-Generated Content
Signal outputs, trade ideas, and market commentary on HarborSignal are generated by artificial intelligence models. You acknowledge that:
- AI-generated content may be inaccurate, incomplete, or misleading.
- AI models do not have access to material non-public information.
- Past patterns identified by AI do not predict future market movements.
- AI outputs are not a substitute for professional financial analysis.
5. Data Accuracy Disclaimer
Vessel data is sourced from third-party AIS (Automatic Identification System) providers. Price data is sourced from third-party financial data providers. HarborSignal makes no representations regarding the accuracy, completeness, timeliness, or reliability of any data displayed on the platform. Data may be delayed, incomplete, or contain errors. You use all data at your own risk.
6. Acceptable Use
You agree not to:
- Redistribute, resell, or sublicense any data or signals from the Service.
- Use automated tools to scrape or bulk-download data from the Service.
- Use the Service to violate any applicable law or regulation.
- Misrepresent HarborSignal signals as your own original research or analysis.
- Use the Service in any way that could damage, disable, or impair the platform.
7. Subscriptions and Payment
Paid subscription tiers, if offered, are billed on a recurring basis. Any subscription fee is charged solely for access to HarborSignal as a general-purpose information publication — it does not constitute payment for personalized investment advice, individualized recommendations, or any advisory relationship. You may cancel at any time. Cancellations take effect at the end of the current billing period. HarborSignal does not offer refunds for partial billing periods. HarborSignal reserves the right to change pricing with 30 days' notice.
8. Intellectual Property
All content, software, design, and trademarks associated with HarborSignal are the property of HarborSignal or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. No other rights are granted.
9. Third-Party Data and Services
The Service relies on third-party data providers including AIS data providers, financial data APIs, and cloud infrastructure. HarborSignal is not responsible for the accuracy or availability of third-party data. Use of certain data may be subject to additional third-party terms.
10. Limitation of Liability
To the fullest extent permitted by applicable law, HarborSignal and its officers, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, trading losses, loss of data, or business interruption, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory.
HarborSignal's total liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid to HarborSignal in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless HarborSignal and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service or violation of these Terms.
12. Termination
HarborSignal reserves the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, HarborSignal, or third parties, or for any other reason at HarborSignal's sole discretion.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Illinois.
